ACCC opposes keg pooling supplier MicroStar’s proposed acquisition of Konvoy assets

The ACCC has decided to oppose MicroStar Logistics LLC’s (MicroStar) proposed acquisition of the assets of Konvoy Holdings Pty Ltd (Receivers and Managers Appointed) (Konvoy), both of which supply keg pooling services to brewers across Australia.

MicroStar, which operates under the name Kegstar in Australia, and Konvoy are the only suppliers of keg pooling services, which enable brewers to rent kegs on a short-term basis to supply alcoholic drinks on tap to licensed venues.

“Our investigation has found that MicroStar acquiring the assets of Konvoy, the only other provider of keg pooling services in Australia, would be likely to substantially lessen competition,” ACCC Commissioner Dr Philip Williams said.

While independent brewers can use their own kegs or leased kegs, the ACCC considers that these options generally serve different purposes and would not be a viable alternative should keg pooling prices increase.

For example, owning kegs or renting them under long-term leases may be suitable when independent brewers are located close to the licensed venues, but these models are unlikely to be viable when servicing venues located further away.

“Without competitors, MicroStar could increase prices above a competitive level and reduce services or quality of service for customers,” Dr Williams said.

“Higher prices for keg pooling would have a significant impact on many independent brewers.”

The ACCC noted that Konvoy is in receivership and that its assets may ultimately be liquidated.

“Our view is that if the proposed acquisition does not proceed, the Konvoy business is likely to continue, whether under new or existing ownership; however, we recognise that liquidation of the assets is also a potential outcome,” Dr Williams said.

“If Konvoy’s assets are liquidated, they would likely remain in the market and be available to new or emerging rivals to MicroStar, or to independent brewers.”

Background

MicroStar is the largest independent keg services company in the United States with operations in the UK, Europe, Australia and New Zealand. It entered the Australian market in 2021 via the acquisition of the Kegstar business from Brambles.

In Australia, Kegstar handles the activities and costs relating to a brewery’s keg use (for example, keg capital costs, reverse logistics, repair and maintenance, and keg management labour) under a pay-per-fill (PPF) model.

Under the PPF model, a brewery will order the number of kegs it requires, these are then delivered to the brewery for them to clean, fill and ship to the brewery’s customers. The brewery provides information on full keg deliveries to Kegstar who then tracks the kegs to the brewery’s customers (i.e. licensed venues), and then Kegstar arranges to collect the empty kegs for further use by its PPF customers. Brewers will pay for this PPF service based on the number of kegs that the brewery refills.

Konvoy operates a keg services business in Australia where it provides keg rentals on a short-term basis, known as “keg pooling”; and it leases kegs on a long-term basis, for a period of 12-60 months, known as “keg leasing”. Under its long-term keg leasing, brewers can lease kegs for their brewery for a monthly fee.

For its keg pooling, Konvoy stores and maintains a fleet of serviced kegs which are delivered to brewers as needed in exchange for a fixed fee. The brewers will then clean, fill and distribute the kegs. Konvoy tracks the kegs and arranges a pickup from the brewer’s customers, usually licensed venues, once they are empty.

In addition to these leasing services, Konvoy offers separate keg maintenance and repair and branding services. It also sells kegs to customers and supplies a tracking technology, known as ‘Katch’, as part of its logistics offering which assists with tracking kegs across the supply chain.

Konvoy entered receivership and administration on 11 March 2025. The Receivers determined that a sales process for Konvoy’s assets would provide the best return to creditors.

Witnesses sought to Commonwealth Avenue bridge motorcycle collision

ACT Policing is seeking witnesses and dash-cam footage of a two vehicle collision on Commonwealth Avenue bridge yesterday (Tuesday, 5 March 2024).

About 12.50pm, police and emergency services were called to a collision between a Toyota sedan and a black motorcycle on Commonwealth Avenue bridge, Barton.

The motorcycle rider, a 31-year-old man, was treated at the scene by ACT Ambulance Service paramedics before being transported to hospital in a serious but stable condition.

Police are investigating the circumstances of the collision, and would like to speak to anyone who witnessed the incident or who may have dash-cam footage from the area around the time of the incident.

Public assistance sought following man using fake online dating profiles

ACT Policing is calling for information from the public after a man allegedly created fictitious accounts on various online dating applications.

Between January 2023 and January 2024, the man is believed to have used fake photos and a fake name to engage with several women via online dating platforms.

In one incident, the man is alleged to have exchanged his mobile number and residential address with a woman under the guise of the fake identity as presented on his dating profile.

It is further alleged that when the man and woman met up, the man committed an act of indecency on the woman.

The man was subsequently charged with committing an act of indecency without consent.

Police have already spoken to a number of people in relation to this matter, and are urging anyone who is yet to speak to police or who has information about this matter to come forward.

ACT Policing is seeking witnesses and dash-cam footage of a single vehicle motorcycle collision in Monash.

About 3.30am yesterday (Sunday, 3 March 2024), police responded to reports of a single motorcycle collision on Charleston Street, Monash.

The motorcycle rider, a 23-year-old man, was treated at the scene by ACT Ambulance Service paramedics before being transported to hospital in a serious condition.

ACT Policing’s Major Collision Team are now investigating the circumstances of the incident.

Witnesses sought to family violence incident

ACT Policing is seeking witnesses to a family violence incident that occurred during the afternoon and evening of Thursday, 29 February 2024.

About 5pm, a woman left a Franklin residence on foot, headed towards the nearby Nullarbor Avenue light rail stop.

A short time later, a man driving a white Tesla bearing ACT registration YQC69P allegedly arrived at the light rail stop, and requested the woman get in the vehicle.

Following a short conversation, the woman got into the vehicle, where the man allegedly began to drive away with the passenger door still open.

Police allege that the woman was subsequently confined in the car whilst being driven around the Gungahlin region, where the man has allegedly assaulted the woman a number of times.

A short time later, the vehicle has stopped on the side of the road near Haydon Drive, Bruce where both the man and woman got out of the car. However, they both re-entered the car after a few minutes before driving to the Gungahlin region again.

The woman was eventually able to leave the man’s residence about 7.30pm that evening before seeking refuge at a friend’s house and contacting police.

About 11.10am on Friday, 1 March 2024, police were conducting mobile patrol in Gungahlin when they observed the man driving the Tesla.

He was subsequently arrested and faced the ACT Magistrates Court yesterday (Saturday, 2 March) charged with three offences – forcible confinement, choke, suffocate, or strangle another person, and recklessly inflict actual bodily harm.

Police would like to speak to anyone who may have witnessed the incident, or the Tesla vehicle being driven in Gungahlin or Belconnen on Thursday, 29 February – police understand the woman may have called out to other road users for help whilst in the car.

Police seek to identify man involved in filming incident

ACT Policing is seeking assistance from members of the public to identify a man involved in an unauthorised filming incident at the Canberra Outlet Centre yesterday.

About 10.20am on Wednesday (28 February 2024), the man allegedly followed a woman into the female public toilets located within the Canberra Outlet Centre, Fyshwick.

At this time, it is alleged the man took photos of the woman using the facilities and, once confronted, fled the scene on foot.

UPDATE Gungahlin police station to be temporarily closed

Update issued approximately 9.15am, Wednesday, 6 March 2024

ACT Policing has established a mobile front office at Gungahlin Police Station following the closure of the Gungahlin Joint Emergency Services Centre.

The facility will be staffed by police from 8am to 8pm daily, and will provide basic front office police services, such as allowing members of the public to speak to police, report crimes, and attend for bail requirements. Justice of the Peace services are expected to commence at the site in the coming days.

It is expected this facility will be in place until such time as police are able to return to Gungahlin Police Station.

As a result of a contamination issue at the Gungahlin Joint Emergency Services Centre, ACT Policing will temporarily relocate its officers to another work location.

During planned building works at the centre, routine testing was conducted for a range of hazardous materials. This testing identified traces of lead above acceptable levels in one location as well as diesel particulates. Further investigations are occurring to identify the extent and source of the lead and diesel particulates.

Taking a precautionary approach and to ensure the safety and wellbeing of our staff, ACT Policing and the Emergency Services Agency have enacted business continuity arrangements. Gungahlin station-based police officers will move to the former Traffic Operations Centre (TOC) in Belconnen.

As a result of this move, the front office at the Gungahlin Station will be closed from Thursday 29 February 2024. People seeking face-to-face police assistance can still attend stations in the City, Belconnen, Woden and Tuggeranong or call 131 444.

Gungahlin residents who attend the station to satisfy bail conditions should make alternative arrangements.

Gungahlin patrols will continue to attend incidents in the Gungahlin district with an aim to ensure response times are kept to a minimum.

What to do when motorcades move through Canberra

Do you know what to do when you encounter motorcades on our roads?

ACT Policing will be facilitating multiple high office holder visits to Canberra in 2024 and our motorcade officers would like all drivers to assist us to ensure minimum disruption and maximum safety for all road users.

Planning for these visits takes many months and balances multiple factors including the itinerary of the guest, the security requirements, the motorcade size, the preferred routes and the time of day.

While planners will always seek to minimise the impact of a motorcade movement on road users, from time to time there will be short delays.

If road users encounter police managing a motorcade we ask that they:

  • Be aware of their surroundings at all times.
  • Obey the directions of police – especially at intersections
  • Be patient
  • Don’t drive over median strips or perform illegal u-turns
  • Recognise that the delay will be for a short period only as the motorcade moves through

Police seeking to locate bottle shop robber

Update at 8.35am Friday, 1 March 2024 – Thank you Canberra, the man we posted about on Wednesday has been located and charged with aggravated robbery (offensive weapon), assault occasioning actual bodily harm, possess offensive weapon with intent, aggravated burglary – intent to commit theft, joint commission theft, and destroy/damage property. He is scheduled to appear in the ACT Magistrates Court this morning (Friday, 1 March 2024).

ACT Policing is seeking public assistance to locate a man who attempted to rob a Mitchell bottle shop earlier this month.

About 5.05pm on Friday, 16 February 2024, police allege Mitchell Jacka made demands for cash from the till at a Mitchell bottle shop while brandishing a knife.

The staff member complied with the demand before fleeing the shop and seeking assistance. In the process of fleeing, she was injured as she fell from the counter.

Soon after, a nearby shopkeeper and others attended the bottle shop and engaged with Mr Jacka. He eventually dropped the items in his possession and fled the scene.

Following extensive enquiries, ACT Policing is today seeking public assistance to locate Mitchell Jacka. He is considered a threat to the community and should not be approached.
